Tax & Legal

  • US collectibles tax rate: Physical precious metals sold at profit are taxed at the federal collectibles rate — maximum 28%. Standard long-term capital gains rates (0/15/20%) do NOT apply.
  • Short-term gains: Held ≤1 year, taxed as ordinary income at marginal rate.
  • Inherited metals: Receive stepped-up cost basis to fair market value at date of death.
  • IRA eligibility (IRC §408(m)(3)):
    • Gold: ≥.9950 fineness (exception: American Gold Eagle at 22K is explicitly approved)
    • Silver: ≥.999 fineness
    • Platinum: ≥.9995 fineness
    • Palladium: ≥.9995 fineness
  • Coinage Act of 1792: Established the first US statutory gold-silver ratio at 15:1.
  • Coinage Act of 1965: Removed silver from US dimes and quarters. Signed July 23, 1965.
  • Executive Order 6102 (1933): Required US citizens to surrender gold at $20.67/oz. Repealed by Public Law 93-373 (1974).
