Nauta End-User License Agreement and Terms of Use

This End-User License Agreement and Terms of Use (the “Agreement”) is a legally binding agreement between you, whether acting as an individual or on behalf of an organization or Discord community (“you” or the “Licensee”), and the creators of Nauta, currently known as AverageRoi and B-M198 (“we,” “us,” “our,” or the “Licensor”).

This Agreement governs your access to and use of Nauta, including the Nauta Discord bot, its commands, software, source or executable code where made available, websites, documentation, databases, interfaces, branding, and related materials collectively referred to as the “Software” or “Nauta.”

By adding Nauta to a Discord server, authorizing it, using its commands, downloading or installing any part of it, accessing its website, or otherwise interacting with Nauta, you acknowledge that you have read and agree to this Agreement.

If you do not agree to this Agreement, you must not access or use Nauta and must remove it from any Discord server under your control.

1. Eligibility and Third-Party Rules

You may use Nauta only if:

  1. You are legally capable of agreeing to this Agreement;
  2. You meet Discord’s minimum age requirements in your country;
  3. You are permitted to use Discord and Minecraft-related services; and
  4. Your use complies with all applicable laws and third-party rules.

Your use of Nauta is also subject to Discord’s Terms of Service, Community Guidelines, Developer policies, and any rules imposed by the Discord servers in which Nauta operates.

You are responsible for determining whether your use of Nauta complies with those requirements.

Nauta is an independent project. It is not affiliated with, endorsed by, sponsored by, or officially connected to Discord, Mojang Studios, or Microsoft. All third-party names and trademarks belong to their respective owners.

2. Purpose of Nauta

Nauta is a utility bot intended primarily for Minecraft communities. Depending on the commands, settings, and features currently available, Nauta may allow users to:

  • Store Minecraft coordinates, location names, aliases, dimensions, notes, and related command inputs;
  • Retrieve saved coordinates and location information;
  • Search for nearby saved locations;
  • Edit or delete stored coordinate information when the user has the required permissions;
  • Perform coordinate-related calculations; and
  • Use other Minecraft or Discord community utilities introduced in later versions.

Features may be added, changed, limited, or removed at any time.

No Self-Hosting or Independent Deployment

The license granted under this Agreement permits access to and use of Nauta only through the official instance operated or expressly authorized by the Licensor.

Unless the Licensor gives prior written permission, you may not:

  • Download, copy, install, deploy, execute, or host Nauta’s source code or executable code on your own computer, server, hosting account, cloud service, Discord application, or other infrastructure;
  • Create or operate your own instance of Nauta;
  • Use Nauta’s code to create or operate a modified, derivative, replacement, or competing bot or service;
  • Share the code with another person for deployment or hosting; or
  • Make Nauta available to third parties from infrastructure controlled by you.

Access to source code, whether through a public repository, accidental disclosure, contribution access, or any other means, does not grant permission to execute, deploy, modify, redistribute, or independently host that code.

Users receive permission only to interact with the official hosted service through its authorized Discord commands and interfaces. All other rights are reserved.

4. Server Owner and Administrator Responsibilities

Discord server owners and administrators are responsible for deciding:

  • Whether Nauta should be added to their server;
  • Which members may use Nauta;
  • Which commands are enabled;
  • Which channels may access Nauta;
  • Which roles or users may add, view, edit, or delete stored information; and
  • Whether the information stored through Nauta is appropriate for their community.

You are responsible for configuring Discord roles, channel permissions, application-command permissions, and Nauta settings in a manner appropriate for your server.

An action performed by a user who has been granted the necessary Discord or Nauta permissions will ordinarily be treated as authorized by the server.

Coordinate data may reveal in-game locations such as bases, farms, portals, structures, storage areas, or other locations. Server owners and administrators are responsible for determining what may be stored and who may access it.

We are not responsible for harm caused by incorrect, overly broad, or improperly configured server permissions.

5. Acceptable Use

You may not use Nauta to:

  1. Violate any applicable law, regulation, court order, Discord rule, server rule, or this Agreement;
  2. Harass, threaten, deceive, target, exploit, or harm another person or community;
  3. Store personal data, real-world addresses, private contact information, passwords, authentication tokens, API keys, financial information, or other sensitive information in coordinate names, aliases, notes, command inputs, or other Nauta fields;
  4. Access, change, delete, export, or interfere with data that you are not authorized to access;
  5. Spam commands, evade rate limits, overload the bot, perform denial-of-service activity, or disrupt Nauta’s operation or infrastructure;
  6. Probe, scan, attack, exploit, or bypass any authentication, permission, rate-limit, security, or access-control mechanism;
  7. Introduce malware, malicious code, destructive commands, or other harmful material;
  8. Misrepresent Nauta, impersonate its creators, or falsely claim affiliation with the project;
  9. Use Nauta or data obtained through Discord for unauthorized surveillance, profiling, advertising, data brokerage, or machine-learning training;
  10. Scrape, crawl, harvest, or extract Nauta data or content through automated means other than the bot’s officially provided commands and interfaces;
  11. Copy, reproduce, redistribute, sell, rent, lease, sublicense, rebrand, or commercially exploit Nauta or any substantial part of it without prior written permission;
  12. Modify, translate, adapt, reverse engineer, decompile, disassemble, or attempt to discover the source code or internal operation of Nauta, except to the limited extent that applicable law expressly permits such activity despite this restriction;
  13. Remove or alter copyright notices, attribution notices, trademarks, watermarks, or other ownership information; or
  14. Use Nauta in a manner that creates legal, security, operational, or reputational risk for Nauta, its users, Discord, its infrastructure providers, or its creators.

We may restrict, suspend, or block access when we reasonably believe Nauta is being misused or continued access may create risk.

6. User Content and Coordinate Data

Information submitted through Nauta, including coordinate names, aliases, dimensions, notes, locations, and command inputs, is referred to as “User Content.”

You retain any ownership rights you may have in your User Content. You remain solely responsible for it.

By submitting User Content to Nauta, you represent that:

  • You have the right to submit it;
  • Its submission and use do not violate applicable law;
  • It does not violate this Agreement, Discord’s rules, or the rules of the relevant server; and
  • It does not infringe another person’s intellectual-property, privacy, confidentiality, or other rights.

You grant the Licensor a limited, worldwide, royalty-free license to host, store, reproduce, process, display, transmit, modify for technical purposes, and delete User Content only as reasonably necessary to:

  • Operate Nauta;
  • Provide requested commands and features;
  • Maintain and improve service reliability;
  • Troubleshoot technical problems;
  • Prevent abuse or security incidents;
  • Enforce this Agreement; and
  • Comply with applicable legal obligations.

This permission ends when the relevant content is deleted from our active systems, except where temporary backups, security records, or legal-retention obligations require continued storage.

7. Accuracy and In-Game Risk

Nauta does not verify that stored coordinates or other User Content are accurate, complete, current, authorized, or safe.

Coordinates may become incorrect because of:

  • Minecraft server resets;
  • World changes;
  • Dimension or scaling differences;
  • User error;
  • Changes made by other authorized users;
  • Deleted or moved structures;
  • Plugin or mod changes; or
  • Technical failures.

You use stored coordinates at your own risk. Nauta is not responsible for in-game losses, destroyed items, lost progress, player-versus-player encounters, bans, traps, griefing, or any other consequence of relying on stored information.

8. Privacy and Data Processing

Nauta’s Privacy Policy explains what information may be collected, why it is collected, how it is used, how long it may be retained, and how deletion requests are handled.

The Privacy Policy is incorporated into this Agreement by reference. By using Nauta, you also agree to the Privacy Policy.

We may process information as reasonably necessary to:

  • Provide and maintain Nauta;
  • Associate stored data with the correct Discord server or user;
  • Respond to commands;
  • Enforce server permissions;
  • Diagnose failures;
  • Prevent fraud, abuse, or security incidents;
  • Improve reliability; and
  • Comply with legal obligations.

We do not sell Discord API data.

When Nauta is removed from a Discord server, the server’s data may be retained temporarily and then deleted in accordance with the deletion period stated in the Privacy Policy.

You must not use Nauta as a storage location for sensitive personal information.

9. Intellectual Property

Nauta and all intellectual-property rights associated with it belong to the Licensor or the applicable third-party licensors.

Protected materials may include:

  • Source code and executable code;
  • Algorithms and software architecture;
  • Commands and original bot functionality;
  • Documentation and website text;
  • Databases and database structures;
  • Graphics, icons, logos, designs, and animations;
  • Audio, video, and other media;
  • Names, branding, and service identifiers; and
  • Original written or visual content.

Except for the limited license expressly granted in Section 3, this Agreement does not transfer any ownership interest or intellectual-property right to you.

All rights not expressly granted are reserved by the Licensor.

Third-party libraries, templates, APIs, and other materials remain subject to their respective licenses and ownership terms.

10. Feedback and Contributions

You may voluntarily provide ideas, suggestions, feature requests, bug reports, or other feedback.

Unless we separately agree otherwise in writing, you grant us a perpetual, worldwide, irrevocable, transferable, sublicensable, and royalty-free right to use, reproduce, modify, publish, implement, and otherwise exploit that feedback without payment, attribution, or other obligation to you.

Code contributions accepted into a Nauta-controlled repository may be subject to additional contribution terms or the license identified for that repository.

11. Service Availability, Updates, and Support

Nauta is currently provided as a free service.

We may provide updates, bug fixes, maintenance, or new features when we consider them appropriate, but we are not required to:

  • Maintain any particular feature;
  • Follow a fixed update schedule;
  • Provide customer or technical support;
  • Continue supporting older commands or configurations;
  • Preserve compatibility with every Discord or Minecraft update; or
  • Continue operating Nauta.

Nauta may be unavailable, delayed, interrupted, restricted, or discontinued at any time.

We do not guarantee that Nauta will be:

  • Continuously available;
  • Error-free;
  • Secure against every possible threat;
  • Suitable for a particular server;
  • Compatible with every device, bot, plugin, mod, or server configuration; or
  • Able to preserve all stored information.

We are not responsible for outages or failures involving Discord, hosting providers, database providers, internet services, Minecraft servers, third-party APIs, or events outside our reasonable control.

You should maintain an independent copy of any information that is important to you or your community.

12. Future Paid Features

Nauta is currently free, but we may introduce optional paid features, subscriptions, donations, sponsorships, or other funding methods in the future.

Paid features may be subject to separate terms disclosed before purchase.

Payment, donation, or financial support does not grant ownership of Nauta, its code, branding, infrastructure, or data systems and does not permit you to bypass this Agreement.

13. Suspension and Termination

You may terminate this Agreement at any time by stopping your use of Nauta and removing it from Discord servers under your control.

We may restrict, suspend, or terminate access to Nauta for a user or server when:

  • This Agreement has been violated;
  • Nauta is being abused or used in a risky manner;
  • Discord or another platform requires or requests action;
  • Continued access may harm Nauta, its users, its developers, or its infrastructure;
  • We are required to act for legal or security reasons; or
  • We discontinue Nauta or a particular feature.

Termination may occur without prior notice where immediate action is reasonably necessary.

Upon termination:

  • The license granted under this Agreement ends immediately;
  • You must stop accessing and using Nauta;
  • We may disable commands or block a user or server;
  • Stored data may become inaccessible or be deleted; and
  • Provisions that by their nature should survive termination will remain effective.

Termination does not limit any rights or remedies arising from conduct that occurred before termination.

14. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Nauta is provided “as is” and “as available,” with all faults and without warranties of any kind.

The Licensor disclaims all express, implied, statutory, and other warranties, including warranties of:

  • Merchantability;
  • Fitness for a particular purpose;
  • Accuracy;
  • Reliability;
  • Availability;
  • Security;
  • Quiet enjoyment;
  • Title; and
  • Non-infringement.

Nauta is a convenience utility for Minecraft communities. It is not a backup service, security service, moderation service, emergency service, professional service, or legal service.

You assume all risks arising from your access to or use of Nauta.

Nothing in this Agreement excludes a warranty or consumer right that cannot lawfully be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, the Licensor and Nauta’s creators, contributors, maintainers, hosting providers, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

This limitation includes damages relating to:

  • Lost or corrupted data;
  • Lost profits or revenue;
  • Loss of access;
  • Server disruption;
  • Business interruption;
  • In-game losses;
  • Loss of reputation;
  • Security incidents;
  • Reliance on inaccurate coordinates; or
  • The suspension, modification, or discontinuation of Nauta.

The limitation applies regardless of whether liability is alleged under contract, tort, negligence, strict liability, warranty, statute, or another legal theory, even if the possibility of such damage was known or foreseeable.

To the fullest extent permitted by law, the total aggregate liability of the Licensor for all claims arising from or relating to Nauta or this Agreement will not exceed the greater of:

  1. The amount you paid directly to the Licensor for Nauta during the twelve months preceding the event giving rise to the claim; or
  2. EUR 10.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, the exclusions and limitations apply only to the maximum extent permitted by law.

16. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Licensor and Nauta’s creators, contributors, maintainers, and representatives from claims, liabilities, damages, judgments, losses, costs, and reasonable professional or legal fees arising from:

  • Your use or misuse of Nauta;
  • Your violation of this Agreement;
  • Your violation of applicable law or third-party rules;
  • User Content submitted by you;
  • Your infringement of another person’s rights;
  • Your administration or configuration of Nauta in a Discord server; or
  • Conduct performed through your Discord account or with permissions you granted.

This section does not require indemnification to the extent prohibited by applicable law.

17. Changes to Nauta or This Agreement

We may modify Nauta or this Agreement from time to time.

When this Agreement changes, the “Last updated” date will be revised. For material changes, we may also provide notice through the Nauta website, Discord, the bot, GitHub, or another reasonable method.

Unless otherwise stated, updated terms become effective when published.

Your continued use of Nauta after updated terms take effect constitutes acceptance of the revised Agreement. If you do not agree to a revision, you must stop using Nauta and remove it from servers under your control.

18. Assignment and Transfer

You may not assign, transfer, sublicense, or delegate this Agreement or any rights granted under it without the Licensor’s prior written consent.

Any attempted assignment or transfer made without that consent is void.

The Licensor may assign or transfer this Agreement as part of a project transfer, reorganization, merger, acquisition, sale of assets, or change in the person or entity responsible for operating Nauta.

19. Notices and Contact

Notices under this Agreement must be provided in writing.

Electronic notice may be delivered through:

  • A Discord message;
  • An announcement through Nauta;
  • The Nauta website;
  • A project-controlled GitHub page or repository; or
  • Another contact method made available by the Licensor.

20. Governing Law and Jurisdiction

This Agreement is governed by the laws of Spain, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, any legal action arising from or relating to this Agreement or Nauta must be brought exclusively before the competent courts of Spain, and the parties consent to the jurisdiction of those courts.

Nothing in this section removes any mandatory consumer right to bring a claim in another court where applicable law does not permit that right to be waived.

21. Severability

If any provision of this Agreement is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or limited to the minimum extent necessary to make it enforceable.

The remaining provisions will remain in full force and effect.

22. No Waiver

A failure or delay by the Licensor in exercising a right or enforcing a provision of this Agreement does not waive that right or provision.

A waiver is effective only if made expressly in writing by the Licensor.

23. Entire Agreement

This Agreement, together with the Privacy Policy and any additional terms expressly applicable to a particular Nauta feature, constitutes the entire agreement between you and the Licensor concerning Nauta.

It replaces any prior or contemporaneous oral or written agreements concerning the same subject matter.

If separate written terms for a specific feature conflict with this Agreement, those separate terms control only with respect to that feature.

24. Interpretation

Headings are included for convenience and do not affect interpretation.

Words such as “including” and “includes” mean “including without limitation.”

This Agreement will not be interpreted against either party solely because that party drafted or proposed part of it.

25. Acceptance

By adding, authorizing, accessing, installing, downloading, or using Nauta, you confirm that you understand and accept this Agreement.

If you do not accept it, you must not use Nauta and must remove it from any Discord server under your control.
