bitchan — Ratifying Convention Record

The constitution is ratified by a convention of the 42 Framers (the framer-council skill). Each delegate evaluates the charter in character, against his own documented constitutional tests, and votes RATIFY / RATIFY WITH AMENDMENTS / REFUSE.

First Reading — Quorum (13 of 42)

Tally: 0 RATIFY · 13 RATIFY WITH AMENDMENTS · 0 REFUSE Determination: RATIFIED, conditional on the amendments below. Unanimous support, unanimous conditions. Notably even Mason did not refuse — bitchan put a Bill of Rights first (Article I), the very omission that made him refuse in 1787.

The council's required amendments (its "Bill of Rights"), by support

  1. Constitute the Senate's powers now (≈all 13) — don't defer the checks; route impeachment + treasury oversight + do-not-serve re-affirmation to direct citizen vote until the chamber is constituted at a threshold. → Art V.2
  2. Nail down Article VII with real numbers (≈12) — min account-age, capped cost, an open path, invite-graph slash rules; settled before any election. → Art VII
  3. Sever the President from the purse (≈8) — fee schedule Governable not presidential; ceiling and floor as written numbers; fixed stipend, no cut. → Art III.4, VI
  4. No blanks or cross-references for immutable bounds (≈5, Williamson) — write the actual figures. → Parameters appendix
  5. Harden do-not-serve (Mason, Sherman) — expires unless renewed by an independent body, President excluded. → Art III.3
  6. Protect speech from the everyday mop (Madison, Carroll, Mason) — log every hide; never hide opinion or criticism of moderators. → Art III.2
  7. An explicit rights declaration in Article I (Mason) — rights stated as rights, not only mechanisms. → Art I.6

The dissent, in voice

Mason: "A mechanism is not a right… I will not sign a document that buries the right of free press inside a structural mechanism while leaving its Senate deferred and its fee ceiling unnamed." — Held, then persuadable: grant the rights declaration, the do-not-serve check, and the Senate's powers, and he signs.

All seven amendments are incorporated into Constitution v2, along with the founding-period (Washington model) and year-end-election decisions.

Final Ratification — Full 42 (on Constitution v2)

Tally: 21 RATIFY · 21 RATIFY-WITH-AMENDMENTS · 0 REFUSE. Determination: RATIFIED — unanimous assent, conditional on the second-round amendment package (incorporated into Constitution v3).

Waves 1–3 (architects, compromisers, Southern bloc) ratified outright — confirming the first-reading amendments had landed. Waves 4–6 were run hardened (priming stripped, explicit license to refuse) and unanimously ratified with amendments, converging on one theme: the charter granted and bounded powers but provided no process to contest their exercise — it was missing a judiciary.

The dissent held but was won: Mason (persuaded by the rights-first structure), Gerry — who refused the actual U.S. Constitution — conditioned rather than refused, and Randolph the swing came over ("I will not foreclose the Union before it draws breath").

Second-round amendment package (by support → incorporated in v3)

  1. A judiciary / right of contest (≈10) — any citizen may contest a hide / do-not-serve / slash / result before an independent body that can void it (Blair, Ingersoll, Livingston, McHenry, Carroll, Mason, Randolph, Mifflin). → Art X
  2. Close the custodian-checks-president loop (≈7) — re-affirmation & slash by citizen supermajority, not the President's appointees. → Art III §3, VII §3
  3. Write every quorum/fraction/denominator in-text (≈7). → Art V §1–2, Parameters
  4. Open the treasury books (≈3) — immutable on-chain ledger + sortition auditors. → Art VI §4
  5. Raise the account-age floor to 60 days (≈4). → Parameters
  6. Immutable-ize conscience/opinion (Mason, Bassett, Carroll). → Art I §7
  7. Sharp catches incorporated: rate-limit on citizenship cost (Baldwin); slash needs a hearing (Mason); founder do-not-serve bounded/suspended (Bassett, Gerry); named on-chain transition registry on a clean roll (Mifflin, McHenry); citizen early-election trigger at ≥T/2 (Baldwin); Gerry's 60%-no-quorum recall valve; "injurious" defined by enumerated grounds (Gerry, Ingersoll).

Held against amendment (founder's calls): term stays immutable 1 year (Jenifer's governable-term rejected); fee/cost stays rate-limited, no absolute ETH ceiling (Morris/Few's ceiling declined — staking-trap), softened by extending the rate-limit to the citizenship cost.

Post-ratification footnote: the term decision was later reopened — the charter now sets a Governable band [1yr → 2yr], default 1yr, with re-election as the runway mechanism (adopting what Hamilton and Jenifer pressed here). See the revision note at the end of CONSTITUTION.md.

Gerry, in voice: "I have been taught by experience the danger of the levelling spirit — and the equal danger of the man who, finding himself alone at the wheel, persuades himself that his own virtue is security enough for a free people; grant these amendments, and I shall most cheerfully add my name."

The constitution is ratified. v3 is the founding charter.
