This license governs the PRO edition of this software (the "Software") as distributed by initMAX s.r.o. ("initMAX") through the initMAX package repository, the initMAX Portal, or any other official initMAX channel. By installing or using the Software you agree to these terms.
Subject to payment of the applicable fee, initMAX grants you (the "Licensee") a perpetual, non-exclusive, non-transferable license to install and use the Software within your own organization, on Zabbix installations operated by or for your organization.
You may NOT:
- redistribute, resell, rent, lease, sublicense, or otherwise make the Software or any part of it available to any third party;
- share, publish, or disclose your personal repository access token;
- remove or alter copyright notices, license files, or product branding;
- use the Software to provide a competing product or service.
You MAY modify the Software for your own internal use. Modified copies remain subject to this license and must not be distributed.
The Software is licensed, not sold. initMAX retains all right, title, and interest in and to the Software. Components of the Software that are also published separately under the GNU AGPLv3 (the FREE edition) remain available under that license from the public repository; this license applies to the PRO edition as distributed to you.
Access to updates is provided through the initMAX repository using your personal access token issued via https://portal.initmax.com. Support is provided per the terms of your purchase.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
IN NO EVENT SHALL INITMAX BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR ITS USE. INITMAX'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE LICENSEE FOR THE SOFTWARE.
This license terminates automatically if you breach any of its terms. Upon termination you must uninstall and destroy all copies of the Software. Sections 3, 5, 6, and 8 survive termination.
This license is governed by the laws of the Czech Republic. Any disputes shall be resolved by the courts of the Czech Republic.
