Browser/OS you are experiencing the problem with - IE8
To replicate the problem - just remove <!DOCTYPE html> from index.html from
simplemodal-demo-confirm-1.4.4.zip file which you have provided or you can
replace existing index.html with aatached index.html
The issue is - It overlays both html page and modal and nothing can be done.
If applicable, please list the other code/libraries/plugins you are trying
to integrate with - No other library used
